It outlines federal statutes election officials must adhere to.

The Justice Department on Wednesday released guidance intended to caution states embarking on so-called post-election 'audits' of vote counts for the 2020 presidential election that they must not run afoul of federal voting laws.

The guidance, previously previewed last month by Attorney General Merrick Garland in his policy address on voting rights, outlines federal statutes that the department says elections officials must adhere to during such "audits," such as preserving all federal elections materials and making sure they're not tampered with.

"This document sets down a marker that says the Justice Department is concerned about this, and we will be following this closely," a DOJ official told reporters on a media conference call Wednesday.

The guidance echoes a warning sent by the department back in May to the Republican-run audit in Arizona, warning officials there that all election records must be preserved and expressing concern about the state handing over election materials to the private contractor group Cyber Ninjas.

After the department's letter, Arizona officials backed off of a plan to send contractors from the group to visit homes in the state's largest county of Maricopa to ask voters whether or not they had cast ballots. The Wednesday guidance includes a warning that officials who seek to embark on such "audits" can't do so in a way that will intimidate voters.

DOJ officials on Wednesday declined to provide any update on the department's review of the Arizona "audit." But the guidance comes as Republicans in several other states have expressed interest or are already moving forward with similarly partisan reviews of the 2020 vote count in certain jurisdictions – despite lacking any evidence of widespread fraud.

The department also issued separate guidance Wednesday that outlines the range of federal laws protecting voting by different methods.

"It's responsive to the fact that more Americans than ever are voting, not on Election Day in person in a polling place, but that are voting at voting centers or voting early or voting by mail," one official said.

An official said that the second set of guidance should be a note of caution to states that might be looking to roll back policies that expanded access to voting during the COVID-19 pandemic. The official gave the example of the election bill passed this year by Republicans in Georgia that implemented voting restrictions the department is now suing over, alleging it unlawfully targets minority communities.

"You should not assume that if you abandon the practices that have made it easier for people to vote, that abandonment is not going to get scrutiny from the Department of Justice," an official said.

According to court documents and statements made in court, MS-13 is a national and transnational gang composed largely of individuals of Salvadoran or Central American descent. The purpose of the MS-13 enterprise includes preserving and protecting the power, territory, reputation and profits of the enterprise through the use of intimidation and violence, including murder and promoting the enterprise through acts of murder, robbery, drug trafficking and other criminal activities. Branches or “cliques” of MS-13 operate throughout the United States, including in Nashville.

The indictment charges members of one such clique operating in Nashville, specifically the Thompson Place Locos Salvatrucha clique, with committing a wide range of offenses, including the murder of seven individuals, the attempted murder of an additional five individuals, drug distribution, robberies, kidnappings and assaults. More specifically, the indictment charges the following acts of violence occurring over an approximately 17-month period:

As alleged in the indictment, MS-13 gang members often target individuals for violence based on the gang’s belief that an individual is a rival gang member or a potential witness to crimes committed by the MS-13 members. MS-13 members are required to follow various rules, chief among them being that cooperation with law enforcement is strictly prohibited, and it is well understood within the gang that anyone who assists the authorities will be punished with death; that members are required to confront, fight and/or kill rival gang members when possible; and that members are required to retaliate quickly and viciously against anyone who disrespects or threatens the gang’s authority, power, reputation or control of a neighborhood. Participation in such violent acts by a member increases the respect accorded to that member, results in that member maintaining or increasing their position in the gang, and could result in a promotion to a leadership position.

The defendants are charged with RICO conspiracy, murder and other violent crimes in aid of racketeering, witness tampering, causing death through the use of a firearm, using a firearm during a crime of violence, possessing a firearm during a drug trafficking crime, and violations of the Controlled Substances Act, among other crimes. The statutory penalties for the charged offenses range from a statutory maximum of 10 years to life imprisonment. Blessed Health Care in Campsie shamed after charging $250 for Covid vaccine

A Sydney health care clinic has been caught out charging an eye-watering fee for residents in a Covid-ravaged area to get the jab.

A health care clinic in Sydney’s southwest is charging hundreds of dollars for residents to get their hands on a Pfizer vaccine.

Blessed Health Care clinic has been caught out, asking patients to pay up to $250 for a “vaccination consultation” on their first visit, while the second dose could set them back up to $120.

A notice posted to the window of the clinics, which operate out of two sites in Campsie, said the vaccine itself was free but the consultation fee would leave people out of pocket.

The clinic is charging patients despite the federal government declaring there is no cost associated with getting the vaccine.

Cumberland councillor Kun Huang posted a message on Facebook, saying the desperation to get vaccinated, and apprehension around the AstraZeneca vaccine, has created a “black market for the Pfizer” vaccine.

Lawyers for the family have said that they will "consider the next steps in moving forward" with the trial, which accuses the weapons manufacturer of engaging in shady marketing practices that praised the qualities of their rifles - one of which was used by the 20-year-old gunman in the 2012 Newtown, Connecticut, shooting.

The event left 20 children and six adults dead.

The offer comes weeks after lawyers representing the family filed a complaint earlier this month, accusing the manufacturer of refusing to "comply with their discovery obligations."

"Remington has treated discovery like a game," the complaint reads. "Unwilling to have this case decided by a jury on the merits with a full record, Remington has sought delay and obfuscation at every turn."

While the lawsuit has been active since 2014, Remington has endured two bankruptcies since then, with the latest filing resulting in an automatic, one-year stay of the court proceedings. The order was recently lifted in June.

Remington also appealed to the Supreme Court in 2019 to reverse the Connecticut Supreme Court decision to allow the case to go to trial. However, the SCOTUS denied the case.

Jury selection for the case is scheduled to take place in September.

Canada Border Officers Vote To Strike, Warn Of Supply Chain Disruption

Thousands of Canada Border Services Agency personnel have overwhelmingly voted to authorize a strike – something that could throw a wrench into port, cross-border trucking, airfreight and international parcel operations.

The strike could happen as early as Aug. 6, the Public Service Alliance of Canada and its Customs and Immigration Union said on Tuesday. The union represents some 8,500 CBSA employees, including officers serving at ports of entry across the country.

The threat of a strike comes as Canada prepares to reopen its land border to nonessential travel for the first time since March 2020. The timing wasn’t lost on the union, which warned that a strike could lead to “significant disruption to the flow of goods.”

The impacts could bring delays to commercial vehicle traffic and impact parcel deliveries and duties collection, the union said.

CBSA officers serving in essential positions are legally barred from striking. But as American Shipper reported, the legal definition of essential is narrow in scope and doesn’t include collection of duties and taxes, according to a federal tribunal ruling.

The Port of Vancouver appears particularly vulnerable as it contends with an unprecedented level of container ship traffic. As the largest port in Canada, any disruption there could have impacts throughout the country and intermodal rail and trucking operations.

The union members have been without a contract since 2018 and are seeking pay parity with other Canadian law enforcement agencies and protections against what they allege is a toxic workplace culture.

“They’ve kept our borders safe, screened travelers entering Canada and ensured the rapid clearance of vaccine shipments,” Chris Aylward, national president of the Public Service Alliance of Canada, said in a statement.

“Now it’s time for the government to step up for them the way they’ve stepped up for Canadians.”

Prime Minister Justin Trudeau told reporters on Tuesday that his government is negotiating with the union and hoped to reach an agreement.

“We’re hopeful that there won’t be any disruptions,” Trudeau told reporters.

Five Eyes warn about hacking dangers in wake of China cyber attacks

Australia’s premier cyber security agency has joined forces with its “Five Eyes” partners for the first time to issue an unprecedented warning about the vulnerabilities cyber hackers are exploiting in the wake of a series of hacks by China.

In a joint statement with its sister agencies in Britain, Canada, the United States and New Zealand, the Australian Cyber Security Centre released advice on the top 30 cyber security vulnerabilities being exploited by hackers over the past 18 months.

The five agencies released the advice partly in response to a wave of hackings orchestrated by China’s Ministry of State Security in which it also paid criminal groups to conduct ransomware attacks to extort millions of dollars from companies. The attack on Microsoft Exchange software topped the list of the biggest vulnerabilities exploited so far in 2021.

Australia last week took the rare step of joining with key allies to formally accuse Beijing of the co-ordinated hackings and engaging contract hackers to steal intellectual property in the attacks, which began in January.

The attacks on Microsoft Exchange software allowed hackers to gain access to the email systems of thousands of users, including in Australia.

The Chinese embassy in Australia rejected the allegations, saying Australia had its own poor record on cyber attacks and was like a thief crying “stop the thief”.

The five agencies warned on Wednesday night that the increased use of remote work options, such as virtual private networks (VPNs) and cloud-based services, had provided more opportunities for cyber attackers. Four of the most targeted vulnerabilities in 2020 related to remote working, VPNs, or cloud-based technologies.

ACSC head Abigail Bradshaw said malicious cyber attackers would continue exploiting weaknesses in everyday products, including Microsoft Office, “unless vulnerabilities are urgently addressed”.

“If Australians become a victim of cyber crime, the ACSC is always ready to offer help and is a one-stop shop for reliable and easy-to-follow advice,” she said.

Eric Goldstein, executive assistant director for the US agency CISA, said organisations that apply the best practices of cyber security, such as “patching”, can reduce their risk to cyber actors exploiting known vulnerabilities in their networks. A “patch” is a set of updates to a program or software that addresses vulnerabilities to better withstand a cyber attack.

“In cyber security, getting the basics right is often most important,” Mr Goldstein said.
